Court rejects Nicollet Island neighbors' appeal

Court of Appeals rejects arguments by opponents of DeLaSalle stadium. Citizens group tried to stop the new stadium for the high school.

Opponents of a football field on Nicollet Island in Minneapolis didn't have any luck with the state Court of Appeals.

A three-judge panel of the court rejected Tuesday an attempt by opponents to reinstate a lawsuit against Minneapolis, the city Parks and Recreation Board and DeLaSalle High School.

Hennepin County District Court Judge Marilyn Rosenbaum threw out the case more than a year ago. The court of appeals affirmed her ruling.

The lawsuit was filed by several groups including Friends of the Riverfront, a group of homeowners on the historic island just off downtown.

The appeals court determined an environmental claim was precluded by a previous administrative determination and that other claims failed as well. The court also rejected a claim that the City Council was biased because President Barbara Johnson sat on DeLaSalle's board of trustees.

Judge Harriet Lansing wrote the 14-page decision also signed by Chief Judge Edward Toussaint Jr. and Judge Natalie Hudson.
